| Implementing Guidelines of MEMORANDUM CIRCULAR NO. 03-09
Pursuant to Section 3 (a) of Presidential Decree No. 1986,
the Movie and Television Review and Classification BOARD ("Board" for brevity),
hereby enacts and promulgates the following Rules and Regulations
as guidelines for the proper implementation of Memorandum
Circular No. 03-09.
Chapter I
DEFINITION OF TERMS
Section 1. As used in these implementing guidelines, the following terms
shall mean:
(a) TV PLUGS – Any audiovisual material of short duration
(usually from five(5) seconds to thirty(30) seconds) that are
are shown on television designed to generate public interest
in a television program.
(b) VIDEO WRAPS – Any printed material that are affixed
on any optical media such as CD, VCD, or DVD or on any VHS
tapes, or on any of their enclosures or casings designed
to generate public interest in a motion picture or a television
program.
(c) TRAILERS – Any audiovisual material that are
shown on television designed to generate public interest
in a motion picture intended for theatrical distribution.
Chapter II
SCOPE OF APPLICATION
SECTION 1. – All TV Plugs and Video Wraps must strictly
comply with the General Audience ("G") classification rating,
otherwise, they shall not be approved for television broadcast
or print publication.
SECTION 2. – TV plugs shall follow the mode of
review or classification of the TV program it advertised. The
Board shall review and classify TV plugs based on a sample plug
submitted simultaneous with the sample episode of the TV program
itself. Provided, that all subsequent TV plugs pertaining to one
Tv program must strictly conform to the same classification rating
and tenor of its sample plug. If warranted by the circumstances,
the Board may require the review of all TV plugs prior to their
television broadcast.
SECTION 3. – Video wraps shall follow the same mode
of review and classification prescribed for all print and
sign advertisements.
SECTION 4. – This memorandum circular does not cover
trailers and TV plugs of motion pictures intended for full-
length television broadcast, which shall continue to be governed
by existing rules and regulations appertaining thereto.
Chapter III
REVIEW FEE
SECTION 1. – The prescribed review fee for TV plugs is
Fifteen Pesos (15.00), which shall be assessed based on per
episode of a particular TV program. Regardless of the number
or frequency of TV plugs, or the absence thereof, there shall
be assessed one review fee for all Tv plugs pertaining to one
episode of the subject TV program. The plug review fee shall
be paid simultaneous with the application for permit to exhibit
of the TV program itself.
SECTION 2. – The prescribed review fee for video wraps
shall follow the existing schedule of fees fixed for approval
fee per title for every layout designed for newspaper, poster,
or billboard.
Chapter IV
ADMINISTRATIVE SANCTIONS
SECTION 1. – Any violation of this Memorandum Circular
shall be dealt with in accordance with the provisions of
Chapter XIII of the 2004 Revised Implementing Rules and
Regulations of P.D. No. 1986.
Chapter V
EFFECTIVITY
SECTION 1. – These implementing rules of Memorandum
Circular No. 03-09 shall take effect fifteen (15) days after
its publication in the Official Gazette of in any newspaper
of general circulation in the Philippines.
